PUSL.- The Court of Justice of the European Union (CJEU) has confirmed in it’s latest ruling published on 19th of July that Morocco has no sovereignty over Western Sahara and therefore the EU’s fisheries agreement with Morocco cannot be applied to the territory.
“it follows from the foregoing considerations that the Partnership Agreement and the 2013 Protocol must be interpreted in accordance with the rules of international law binding on the Union and applicable in the relations between the Union and the Kingdom of Morocco. In this sense, the territory of Western Sahara, and the waters adjacent to the territory, do not fall within the respective territorial scope of this Agreement and Protocol”.
This judgement referes to the case brought by the Frente Polisario against the EU Council over the application of the EU-Morocco Fisheries Agreement to Western Sahara in 2014 and confirms the two previous rulings of 21st December 2016 referring to the case presented by Polisario Front and on 27th February 2018 the case of Western Sahara Campaign against the UK Government that was then referred by the UK High Court to the CJEU.
This ruling was published days apart from the negotiations between EU Commission and the Moroccan government who intend to include Western Sahara in the new fisheries agreement. The EU Commission is clearly disrespecting the rulings of the CJEU and looking for a loophole in the ruling that would allow to continue the ilegal exploitation of the resources and violate the right to self-determination, as Morocco has no sovereignty over Western Sahara as the Court argued.
Mohammed Khadad of the Frente Polisario explains the consequences of an agreement that would not respect the CJEU’s ruling and the actions that will be taken by the legitimate representative of the Saharawi:
“While the services of the European Commission are in Rabat, believing they are authorized to sign a new agreement with Morocco to apply to the maritime area of Western Sahara, the decision of 19 July 2018 sends a very clear message on the power of international law, and that the entry into force [of a new agreement] will lead nowhere” ..
“We are following the development of the file, because the agreement must still be endorsed by the European Parliament. If this mechanism of extending the agreement explicitely into Western Sahara was indeed concluded, we would initiate a new appeal before the EU Court. In addition, our lawyers are currently working on a liability claim against the Commission, which we have decided in view of the European obstinacy, and the damage claim amounts to hundreds of millions of euros.”
The fisheries agreement presented by the EU Comission has still to be approved by the European Parliament, shortly we will see if the European Parliament is open to initiate a very dangerous path and open a precedent to disrespect the rulings of the CJEU.
The Polisario Front and the saharawi people have been extremely patient – in the opinion of many to patient – in regards to wait for the International Law to be respected and implemented and their right to self-determination applied beyond shallow words on resolutions. The Moroccan Kingdom is an military and illegal occupier, which has no sovereignty over the territory, who disrespect the cease-fire agreement of 1991 and pursues a strategy of explotation of the natural resources and apartheid politic against the Saharawi population with grave violations of Human Rights, not to mention the genocide it initiated in 1975 and the forced change of demographics with the introduction of hundreds of thousands of settlers.
How can the European Union support and finance this occupation? The very core of the values and objective the Union advertises will be violated, namely
– to contribute to peace, security, the sustainable development of the Earth.
– solidarity and mutual respect among people.
– eradication of poverty and the protection of human rights, in particular the rights of the child.
– strict observance and development of international law, including respect for the principles of the United Nations Charter.
The MEP’s have now a rule to play and can even decide to address the CJEU.

[Bruxelles, 26 Juillet 2018] Le Tribunal de l’Union européenne souligne pour la troisième fois que le Maroc n’aucune souveraineté sur le Sahara occidental et son espace maritime.
Par sa décision du 19 juillet 2018, le Tribunal de l’Union européenne consacre à nouveau le droit à l’autodétermination du peuple du Sahara occidental et la nécessité de son consentement pour tout accord applicable à son territoire et ses ressources naturelles. Relevant que « le Front POLISARIO est un mouvement de libération nationale, fruit de la longue résistance Sahraouie contre les diverses formes d’occupation étrangère », le tribunal souligne que “le territoire du Sahara occidental ne fait pas partie du territoire du Royaume du Maroc » et que « l’expression zone de pêche marocaine ne comprend pas les eaux adjacentes au territoire du Sahara occidental ». Pour le tribunal, une « prétendue volonté de l’Union européenne » de considérer que l’accord UE/Maroc serait applicable au Sahara occidental impliquerait une exécution « incompatible avec le principe d’autodétermination et de l’effet relatif des traités », qui s’impose à l’Union européenne.
Le Tribunal exclut donc, de manière catégorique, toute possibilité pour l’Union européenne d’inclure le Sahara occidental dans ses accords avec le Royaume du Maroc car une telle inclusion constituerait une violation grave et manifeste du droit à l’autodétermination du peuple du Sahara occidental et de son consentement.
Cette décision intervient à la suite du recours du Front POLISARIO de mars 2014 contre l’accord de pêche signé entre l’Union européenne et le Maroc en ce qu’il s’appliquait dans les eaux dépendants du Sahara occidental. Ce recours, introduit devant le Tribunal de l’Union européenne, avait été laissé en attente, la Cour de Justice de l’Union européenne devant d’abord se prononcer sur la question préjudicielle transmise par le juge de Londres (affaire Western Sahara Campaign UK), ce qui avait été fait par l’arrêt du 27 février 2018. La grande chambre de la Cour a jugé que les eaux adjacentes au territoire du Sahara occidental ne relèvent pas du champ d’application territorial de l’accord UE/Maroc.
Mhamed KHADDAD a commenté : « Alors qu’à Rabat, les services de la Commission européenne se croient autorisés à parapher un nouvel accord avec le Maroc pour l’appliquer à l’espace maritime du Sahara occidental, la décision du 19 juillet 2018 fait passer un message très clair sur la force du droit international, et que le passage en force ne mènera nulle part ».
Pour ce nouvel accord, l’Union européenne a obligé le Maroc à reconnaître qu’il n’est pas souverain sur le Sahara occidental, afin de mettre en place un processus d’extension de l’accord UE/Maroc sur ce territoire. Dès lors qu’il est établi que l’accord ne s’applique pas de lui-même, la seule solution est de mettre en place ce mécanisme d’extension explicite, mais ce mécanisme qui est nul car seul le Front POLISARIO, en tant que représentant du peuple du Sahara occidental, peut donner son accord. M. Mhamed KHADDAD conclut : « Nous suivons l’évolution du dossier, car l’accord doit être encore entériné par le Parlement européen, et si ce mécanisme d’extension de l’accord était effectivement conclu, nous engagerions un nouveau recours devant les juridictions de l’Union européenne. Par ailleurs, nos avocats travaillent actuellement sur le recours en responsabilité contre la Commission, que nous avons décidé compte tenu de l’obstination européenne, et le préjudice réclamé se chiffre en centaines de millions d’euros ».
