PUSL.- En raison de l’inefficacité et du manque d’informations de l’ONU et de sa mission au Sahara Occidental (MINURSO) sur la grave situation actuelle dans le territoire occupé du Sahara Occidental, de porunsaharalibre.org (PUSL) nous avons promu l’envoi d’un lettre à tous les membres du Conseil de sécurité de l’ONU avant la réunion du 21 avril.

L’initiative porunsaharalibre.org (PUSL) a été rejointe par plus d’une centaine de collectifs, organisations, associations, syndicats, partis politiques et universitaires au niveau international.

Au fil des décennies, des dizaines de lettres, communications et plaintes ont été envoyées au sujet de la grave situation des Droits de l’Homme dont souffrent les Sahraouis dans les territoires occupés du Sahara Occidental.

Les résolutions des Nations Unies sont claires, le statut juridique est clair, le droit du peuple sahraoui est clair dans tous les avis, résolutions et déclarations que la Cour internationale de La Haye, les Nations Unies, l’Union africaine et la Cour de Justice de L’Union européenne émettent depuis des décennies.

Ce n’est pas un nouveau conflit, le cessez-le-feu qui a malheureusement été violé par les autorités d’occupation marocaines le 13 novembre suite à  l’attaque contre des civils sahraouis dans une zone tampon ainsi que le retrait de tous les personnels  de la MINURSO quelques heures auparavant, ont mis fin au cessez-le-feu et à la reprise du conflit armé.

Les territoires occupés du Sahara Occidental sont en situation de siège militaire et la population sahraouie est brutalement attaquée par les forces marocaines. Cette escalade de la situation sur le terrain est due au silence de la communauté internationale et, en particulier, à l’absence d’un mécanisme de protection de la population civile dans le mandat de la MINURSO, ce qui a permit au Maroc de jouir d’une totale impunité et d’avoir les mains libres dans les territoires occupés.

Même les enfants sahraouis sont brutalement battus et sont victimes de détention arbitraire, de torture et de harcèlement sexuel. Personne n’est épargné. Des centaines de membres des forces de sécurité marocaines, dont des policiers, des gendarmes, des forces paramilitaires et des commandos, sont impliqués dans ces violentes attaques. Les assauts de jour et de nuit contre les maisons des Sahraouis se poursuivent, avec la destruction de leurs biens et les arrestations arbitraires. Les blessés ne se rendent pas à l’hôpital de peur d’être immédiatement arrêtés ou se voir privés de soins médicaux.

Les prisonniers politiques sahraouis sont victimes de procès simulés, détenus dans les prisons marocaines, ce qui constitue en soi un enlèvement et est contraire au droit international, ils sont victimes d’isolement carcéral prolongé, de négligence médicale délibérée, de mauvais traitements et de torture.

Des centaines de véhicules officiels marocains des différentes forces ainsi que des renforts des différents contingents ont été déployés dans les territoires occupés, accentuant encore l’énorme dispositif militaire et policier marocain au Sahara Occidental.

Le mur de séparation militaire marocain, long de 2 720 km, a été prolongé de 50 km et s’étend désormais sur 2 770 km, une autre violation du droit international.

Les forces marocaines ont posé des milliers de nouvelles mines dans une zone censée être sous le contrôle de la MINURSO, sans que rien n’ait été fait pour les en empêcher.

Ce qui se passe au Sahara Occidental est contraire à toutes les valeurs défendues par l’ONU ainsi qu’au Droit International et aux Droits de l’Homme. Les actions du Maroc ne peuvent conduire à une solution pacifique du conflit.

Le peuple sahraoui et son représentant légitime, le Front Polisario, ont respecté toutes les conventions, tous les accords et le droit international depuis l’accord de cessez-le-feu de 1991. Le Maroc ne le fait pas.

Les Sahraouis sont punis pour avoir fait confiance à la communauté internationale et aux Nations Unies. Le silence continu et le manque de protection des Sahraouis par la communauté internationale ont conduit à la situation actuelle, qui est loin d’être «calme» et a donné lieu à un nouveau conflit armé.

Les soussignés rappellent que le Conseil de Sécurité a la responsabilité principale, conformément à la Charte des Nations Unies, du maintien de la paix et de la sécurité internationale. Il n’a absolument pas réussi à le faire au Sahara Occidental.

Nous pensons que les membres du Conseil de sécurité ne sont pas conscients de l’ampleur des violations perpétrées par les forces d’occupation marocaines et que des rapports indépendants ne parviennent pas aux membres.

Il n’est pas acceptable de consulter le régime marocain et ses institutions comme seule source d’information. Les Sahraouis n’ont ni les moyens ni l’occasion de témoigner à Leurs Excellences lors de leurs réunions. Les mécanismes des Nations Unies ne peuvent être actifs sur le terrain et la mission de la MINURSO, si elle n’a pas compétence dans son mandat, ne peut protéger ni la population civile  Sahraouie, ni mettre en œuvre un référendum convenu par les deux parties.

La MINURSO comprend un “personnel civil local” composé de colons marocains, veuillez y réfléchir et voir le manque d’impartialité et d’indépendance que cette situation véhicule.

Excellence, veuillez trouver joins à ce courrier, des informations et des rapports de la situation actuelle sur le terrain. Nous espérons sincèrement que l’escalade de la situation pourra être évitée en mettant enfin en œuvre une solution rapide à travers le référendum d’autodétermination promis au peuple sahraoui, symbole de la résistance non violente et qui s’est avéré au fil des décennies un facteur de stabilisation de la région, respectant le droit international même dans les situations les plus difficiles. Ce peuple qui  vit partiellement dans les camps de réfugiés et les territoires libérés a développé son statut avec des valeurs démocratiques qui respectent la Charte des Nations Unies et ses principes.
