Berlin: (hib/AHE) From the Federal Government’s point of view, the final status of Western Sahara under international law is still unclear. As it writes with reference to earlier answers in its reply (20/1984) to a minor question (20/1458) by the Die Linke party, Western Sahara is a non-autonomous territory within the meaning of Article 73 of the Charter of the United Nations, which, according to the Special Commission on Decolonization of the United Nations General Secretariat, is not under the effective control of an administrative power legitimized by international law. The non-autonomous territory relating to Western Sahara and the territory of the Kingdom of Morocco are subject to different international legal regulations and therefore must be considered separately. “The Federal Government continues to support the efforts of the United Nations to achieve a just, workable and lasting solution to the conflict that is acceptable to the parties based on the relevant Security Council resolutions.”
