Mission of the European Parliament: the institutions of Moroccan have no right to express themselves instead of the people of Western Sahara
On 3 September, and for two days, a European Parliament mission will visit the occupied territory of Western Sahara to gain a better understanding of the situation. The Frente POLISARIO welcomes this effort, which shows the desire to gather as much information as possible before taking decisions. However, it intends to solemnly recall three points that are essential.
The Kingdom of Morocco, which is an occupying military power within the meaning of the Fourth Geneva Convention, has no capacity to exercise any act of sovereignty over the territory. The authorizations that it believes he can give, especially for access to the territory, are worthless under international and European law. Similarly, interlocutors under Moroccan law that will meet the mission can not, by hypothesis, give the slightest opinion on behalf of the people of Western Sahara.
Secondly, the European Commission is working on the illusion of “consultation of the people” in search of “benefits” related to the application of the agreement, whereas the only question that arises is the “consent of the people of the Western Sahara “, which is sovereign, as the CJEU said in paragraph 106 of the judgment of 21 December 2016.
Lastly, all the liberated part of the Moroccan occupation, where the vast majority of Sahrawis live, comes from the territory of Western Sahara. Therefore, the mission of the European Parliament can only have a fair vision if it also goes to the liberated part of the territory, where over 170,000 people living in the refugee camps are waiting for it, and who are under the harsh consitions due to the support of the EU to the military occupation of the territory. The Frente POLISARIO renews this invitation, the Parliament can not remain at partial information.
